Sounds like you're taking out the responsibility for yourself and being ready to blame others for it if you get pictured in a way that doesn't suit you.
I think if you give your permission to have someone use your picture, they have the rights to it.
Whether or not they give it to you is something you agree to beforehand is your decision.
Hmmm, I disagree. What Ben is talking about is if your picture is published, you have the right to use the picture for your own personal, non-commercial reasons, regardless of the original copyright.
So photographs taken at a public venue by a newspaper reporter, event co-ordinator, etc... They would retain copyright. But you'd have the legal right to a copy of the picture for use such as showing to friends/family, putting in your resume, framing for the wall...
This doesn't mean it'd be free of course. Just that you'd have the legal rights.
I think it's a very good idea. But I don't think it should be passed as a law itself. Rather it should be integrated into a complete overhaul of all Intellectual Property law in the US.
Yes, h_postmortemus is exactly right about the kind of use I'm suggesting. If I want to scan a newspaper clipping with my photo in it, from when I was in the Miami Herald wearing a VAX jersey, I should be able to do so.
Note that it would remain my responsibility to obtain a copy of the image to begin with.
